This Transgender Awareness Week, we want to bring attention to transgender immigrants' unique challenges. Despite making up a small percentage of the immigrant population in the United States, transgender immigrants often experience significant barriers when seeking safety, refuge, and asylum. At Yekrangi & Associates, we are committed to helping all immigrants through the complex process of immigration. We understand the challenges you face and are here to help.
When Seeking Asylum
Transgender individuals may face discrimination, violence, and persecution in their home countries based on their gender identity. Transgender immigrants seeking asylum must prove they have a credible fear of persecution based on their gender identity to be granted asylum. Unfortunately, many immigration judges lack cultural competency and understanding of the unique experiences of transgender individuals, making it difficult for them to receive asylum.
Detention Centers
Transgender immigrants are also particularly vulnerable in detention centers. In these facilities, they face violence, and sexual assault at higher rates than non-transgender individuals and are often placed in facilities that do not align with their gender identity, leading to further mistreatment. Many do not access appropriate medical care, including hormone therapy and transition-related surgeries. Transgender individuals are also often placed in facilities based on their sex assigned at birth rather than their gender identity, leading to increased vulnerability to violence and abuse.
Finding Safety in the US
Even after gaining asylum or finding safety in the US, transgender immigrants often face continued discrimination and barriers. In many states, they may not have access to gender-affirming healthcare or legal documentation that reflects their gender identity. This can lead to difficulties finding housing and employment and create barriers to navigating the immigration system.
